12.Dispute Resolution

12.1 The parties will use their best efforts in negotiating with good faith and settling any disputes
arising out of or relating to this Privacy Policy or any breach of it.

12.2 If, for some reason, any such disputes cannot be settled amicably through negotiations
between the parties, or either or both are unwilling to engage in such process, either party may
propose structured negotiations to the other in writing and that they be entered into with the
assistance of a fully accredited mediator before resorting to litigation.

12.3 Any party may appoint a mediator within 14 days of the date of knowledge if the parties are
unable to agree upon a mediator or if the mediator agreed upon is unable or unwilling to act and
an alternative mediator cannot be agreed.

12.4 The parties will meet the mediator to agree the procedure to be adopted for the mediation
within 14 days of the appointment of the mediator (either by mutual agreement of the parties or
in accordance with the mediation procedure) unless otherwise agreed between the parties and
the mediator.

12.5 All negotiations connected with the relevant dispute(s) shall be conducted in confidence
and without prejudice to the right of the parties in any further proceedings.

12.6 Once the parties agree on the dispute resolution mechanism, the agreement shall be
reduced to writing and shall be final once signed by the duly authorised representatives of both

12.7 Either party may exercise any right to seek a remedy through arbitration by an arbitrator to
be appointed by the rules of arbitration provided the parties fail to resolve the dispute(s) within
60 days (or any term as agreed between the parties) of the mediator being appointed, or if
either party withdraws from the mediation procedure.
